(b) If a driver of a vehicle who is involved in an accident is involved in a third-party traffic offense in violation of the State traffic laws of Alabama and his or her driver's license is suspended or revoked after the accident, a record containing the date of the incident, the date of the suspension or revocation, the name, address, Social Security number, driver's license number, color and expiration date of the offender's driver's license, must be placed in the offender's motor vehicle record. (d) A record containing the date of an accident that results in an injury or fatality may be placed in the motor vehicle record of the person who is injured; however, the motor vehicle record does not contain the name, date of birth or identification number of the offender or of any person. Additionally, a law enforcement officer can enter the victim's name in the motor vehicle record to verify the victim's identity. Note: The law authorizing the Secretary of State to retain and use records of motor vehicle infractions for law enforcement purposes (S.B. 566 Section 7.31) was established by the State Legislature to improve the enforcement of the criminal laws and protect the public safety. This law is available to you. If you believe that this law is being violated and have provided all the information available to you in the manner provided, your request is likely to be processed and processed within 180 days.
